1. Acceptance of Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you and Pawer Ltd. (“Pawer”, “we”, “us”, or “our”), governing your access to and use of the Pawer platform, including all related websites, APIs, and services (collectively, the “Service”).
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Description of Service
Pawer is an AI-powered software testing platform that enables users to create automated test sessions for web and mobile applications. The Service includes:
- AI-driven test case generation and execution
- Bug detection with screenshot evidence and severity ratings
- Test session management and result reporting
- Integrations with third-party tools (Jira, webhooks, etc.)
- Mobile application testing (APK upload and automated testing)
- Script generation for test automation
3. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must be at least 18 years old or have legal capacity to enter into a binding agreement.
- One person or entity may not maintain multiple free accounts.
- You are responsible for all activities that occur under your account.
4. Subscription Tiers and Credits
4.1 Free Tier
- 50 credits (one-time allocation)
- 1 concurrent test session
- Web testing only
- Medium-effort AI model
4.2 Premium Tier ($20/month)
- 2,000 credits per month
- 2 concurrent test sessions
- Web and mobile testing
- High-effort AI model
- Jira integration
- Additional credits available at $5 per 500 credits
4.3 Enterprise Tier (Custom pricing)
- Custom credit allocation
- Up to 5 concurrent test sessions
- Configurable mobile testing and script generation access
- High-effort AI model
- Dedicated support
- Custom integrations
4.4 Credit Usage
Credits are consumed per test case action:
- Web test case: 1.0 credit (new), 0.5 credit (retest)
- Mobile test case: 2.0 credits (new), 1.0 credit (retest)
Credits are non-refundable and non-transferable. Unused credits from monthly allocations do not roll over.
5. Acceptable Use
You agree not to use the Service to:
- Test applications or websites you do not own or have authorization to test
- Conduct denial-of-service attacks, load testing, or stress testing against third-party systems
- Upload malicious software, malware, or content that violates applicable law
- Attempt to gain unauthorized access to other users' accounts or data
- Reverse-engineer, decompile, or disassemble any part of the Service
- Circumvent usage limits, credit restrictions, or tier-based feature gates
- Use the Service in any way that violates applicable Vietnamese or international law
- Resell, redistribute, or sublicense access to the Service without our written consent
6. User Content and Data
- You retain ownership of all content you upload to the Service, including application files, screenshots, and test configurations.
- You grant us a limited license to process, store, and display your content solely for the purpose of providing the Service.
- You are solely responsible for ensuring you have the right to upload and test any applications or URLs you submit.
- We may delete test session data, screenshots, and artifacts 90 days after session completion.
7. Third-Party Integrations
The Service may integrate with third-party services (Jira, Google OAuth, webhooks, etc.). Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability, accuracy, or security of third-party services.
8. Availability and Support
- We aim to maintain high availability of the Service but do not guarantee uninterrupted access.
- We may perform scheduled maintenance with reasonable advance notice.
- Support is provided via email. Enterprise customers receive priority support as specified in their agreement.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided “as is” and “as available” without warranties of any kind, express or implied.
- We do not guarantee that the AI testing agents will find all bugs or that test results will be accurate or complete.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service.
- Our total aggregate liability shall not exceed the amount paid by you for the Service in the 12 months preceding the event giving rise to the claim.
10. Intellectual Property
The Service, including its design, code, AI models, branding, and documentation, is owned by Pawer Ltd. and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written consent.
11. Account Suspension and Termination
- We may suspend or terminate your account if you violate these Terms or engage in abusive behavior.
- You may close your account at any time by contacting us. Active subscriptions will not be refunded for partial periods.
- Upon termination, your data will be retained for a reasonable period to comply with legal obligations, after which it will be deleted.
12. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Socialist Republic of Vietnam. Any dispute arising out of or relating to these Terms shall be resolved through negotiation in good faith. If negotiation fails, disputes shall be submitted to the competent courts of Vietnam.
13. Changes to These Terms
We may modify these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. Continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
